1. Introduction

These terms and conditions govern the use of the music tutorial services provided by Melophonics Conservatory (hereafter referred to as "we," "us," or "our"). By using our services, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of them, you must not use our services.

2. Eligibility

To use our services, you must be at least 18 years of age and have the legal capacity to enter into a contract. If the student is a minor, a parent or legal guardian must agree to these terms and assume all financial and legal obligations on their behalf.

3. Services

We provide music tutorial services, including online and in-person lessons, instructional materials, and opportunities to participate in school events, grand recitals, and showcases.

4. Payment and Fees

Payment for our services must be made strictly in advance.

  • Package Payments: For students enrolled in a lesson package, the full package amount must be paid in advance prior to the first lesson of the billing cycle.
  • Per-Session Payments: For students paying on a per-session basis, payment for the upcoming session is required at least 24 hours before the scheduled class.
  • Cancellation for Non-Payment: If advance payment is not received within the required timeframes outlined above, Melophonics Conservatory reserves the right to cancel the scheduled lesson without further notice.
  • Event Fees: Participation in optional events, such as grand recitals or external examinations, may incur separate registration or ticketing fees not covered by standard tuition.

5. Teacher Availability and Punctuality

Melophonics Conservatory will make every effort to ensure that the Services are provided by a qualified and experienced music teacher. In the event that the designated teacher is unable to provide the Services due to illness, emergency, or other unforeseen circumstances, we reserve the right to provide an alternative teacher or to reschedule the lesson without penalty to the student.

To ensure fairness and mutual respect for time, the following policies apply to our teaching staff:

  • Teacher Tardiness: If a teacher is late to a scheduled session, the student is still entitled to their full, paid lesson duration. The teacher will either extend the current lesson to make up for the delayed start time or add the missed minutes to a future session, as mutually agreed upon.
  • Teacher Short-Notice Cancellations: If a teacher must cancel a session with less than 24 hours' notice (and a substitute teacher cannot be provided), the student will receive a priority makeup lesson. This specific makeup lesson will be exempt from the standard 6-day completion window to ensure the student is accommodated at their convenience.
  • Teacher "No-Shows": In the rare event that a teacher fails to attend a scheduled session without prior notice to the student or administration, the student will be credited for that session, and a priority makeup lesson will be arranged at no additional cost.
  • Right of Refusal for Substitute Teachers: We understand the importance of the bond between a student and their primary teacher. If a substitute teacher is offered to cover an absence, the student has the right to decline the substitute and opt for a makeup lesson instead. However, by declining the substitute, the student accepts that the makeup lesson is strictly subject to their primary teacher’s available schedule. If a mutually agreeable time cannot be found, the missed session will be credited toward the student's next billing cycle. No monetary refunds will be issued for declining a qualified substitute teacher.

6. Student Attendance, Cancellations, and Absences

We value the time of both our students and our teachers. The following policies apply to students:

  • Tardiness: Students are expected to arrive on time. If a student is late, the lesson will still end at the scheduled time, and the missed time will not be made up or refunded. Teachers will wait for a maximum of 15 minutes before the lesson is considered a "No Show" and forfeited.
  • Standard Cancellations: If you need to cancel or reschedule a standard lesson, you must provide Melophonics Conservatory with at least 24 hours' written notice prior to the scheduled lesson. Failure to provide 24 hours' notice will result in the forfeiture of the lesson without a refund.
  • Sickness and Medical Emergencies: We understand that sudden illness or medical emergencies occur. If a student cannot attend due to sudden sickness, you must notify us as soon as practically possible. The 24-hour notice requirement will be waived, and the lesson will be rescheduled. Anti-Abuse Clause: To prevent abuse of this policy, Melophonics Conservatory reserves the right to request reasonable documentation (such as a medical certificate) or to deny the waiver if short-notice emergency cancellations become a recurring pattern.
  • Acts of God (Force Majeure): In the event of circumstances entirely beyond the student's control—including severe weather events, natural disasters, localized power outages, or widespread internet disruptions (for online lessons)—the missed lesson will not be forfeited. It will be rescheduled to a mutually agreeable time.
  • Public Holidays: Melophonics Conservatory is officially closed on regular national holidays in the Philippines. Lessons falling on these dates will be automatically rescheduled or credited to the next billing cycle unless prior arrangements have been explicitly made and approved by management.
4

7. Refunds, Withdrawals, and Package Transfers

Melophonics Conservatory does not provide monetary refunds for any fees paid for the Services.

  • Package Transfers: All lesson packages are strictly non-refundable. However, if a student is unable to complete their package, the remaining unused lessons may be transferred to another individual (such as a sibling, family member, or friend). To process a transfer, the original student or guardian must notify Melophonics Conservatory administration in writing.
  • Excused Absences: In the event of an excused absence (as outlined in Section 6), the lesson is not forfeited. A makeup session will be rescheduled to a mutually agreeable time. These sessions are not subject to the 6-day expiration window.
  • Optional Makeup for Forfeited Lessons: If a lesson is forfeited due to a "No Show" or late cancellation (less than 24 hours' notice), the Conservatory may offer an optional makeup class as a courtesy. These specific makeup lessons must be scheduled and completed strictly within 6 days of the originally missed lesson. If not claimed or completed within this window, the lesson is permanently forfeited.

8. Online Lessons and the Virtual Classroom

For students participating in online lessons, it is the student’s sole responsibility to ensure a stable internet connection and functioning audio/video equipment prior to the start of the class. Lesson time lost due to a student’s technical difficulties, lagging, or hardware issues will not be extended, made up, credited, or refunded.

8.1 The Virtual Classroom. Online lessons are held in the Conservatory’s own virtual classroom, reached from the parent portal. Entry requires a current online lesson and observation consent from the parent or legal guardian on record. A student is admitted to a lesson only by their teacher.

8.2 Observation. A member of Conservatory staff may join an online lesson to review teaching quality. Any such observer is shown to everyone present as an observer; the Conservatory does not permit unannounced or invisible observation. A lesson may be observed only while both the student and their teacher are present in it.

6

8. Online Lessons and the Virtual Classroom (continued)

8.3 Lesson chat. Each lesson has one chat, visible to everyone present; there are no private messages. Messages typed there are retained by the Conservatory and may be read by administrative staff. Chat is kept to protect both students and teachers, so that what was said in a lesson is a matter of record rather than one person’s recollection against another’s. Parents may request a copy of the chat for their own child’s lesson.

8.4 What is not recorded. The Conservatory does not record the video or audio of online lessons and keeps no copy afterwards. Section 11 (Media Release) covers photography and videography at studio lessons, rehearsals, recitals and events, and does not extend to online lessons.

8.5 Records kept. The Conservatory records entry to and removal from each online lesson, any observation, the lesson chat, and the teacher’s session notes. These are handled under Section 12 (Data Privacy and Protection).

9. Child Safety and Supervision

Melophonics Conservatory assumes responsibility for minor students only during the exact duration of their scheduled lesson. Parents or legal guardians must be present for timely drop-off and prompt pick-up. We do not provide child-minding services and assume no legal or financial liability for children left unattended in waiting areas before or after their designated lesson time.

7

10. Official Communication Channels

To ensure accurate scheduling and record-keeping, all administrative requests, scheduling changes, cancellations, and billing inquiries must be directed to the official Melophonics Conservatory administration via our designated email, business phone, or front desk. Teachers are not authorized to handle schedule changes or business matters via their personal phones or social media accounts. Messages sent directly to teachers will not be considered official notice.

11. Media Release (Photography and Videography)

Melophonics Conservatory frequently takes photographs and video recordings during regular studio lessons, rehearsals, recitals, and events. These materials are used to celebrate student progress and for promotional, marketing, and advertising purposes on our website, social media pages, and printed materials.

Opt-Out Clause: By accepting these terms, you grant Melophonics Conservatory the non-exclusive right to use your/your child's likeness in such media without compensation. If you do not wish for photos or videos of you/your child to be published, you must explicitly notify us in writing via email or formal letter prior to the start of lessons or events.

12. Data Privacy and Protection

We are committed to protecting your privacy. We collect personal information such as names, contact details, lesson records, and payment records, in order to manage your enrollment, arrange and deliver lessons, communicate with you, process payments, and keep our own school records. Messages you send us, including messages and comments on our Facebook Page, are read and answered with the help of an automated assistant, and are handled by the service providers who help us run the school. We will not sell, distribute, or lease your personal information to third parties unless we have your explicit permission or are required by law to do so. We implement reasonable security measures to safeguard your data against unauthorized access or disclosure. Our full Privacy Policy at app.melophonicsconservatory.com/privacy.html explains what we collect, who else sees it, how long we keep it, and how to ask us to correct or delete it.

13. Code of Conduct and Right to Terminate

A positive and respectful environment is essential for learning. Melophonics Conservatory reserves the right to immediately terminate lessons, without refund, for any student or parent/guardian who exhibits disruptive, disrespectful, abusive, or inappropriate behavior toward our teachers, staff, or other students.

14. Intellectual Property

All instructional materials provided by us are protected by copyright and other intellectual property laws. You may not reproduce or distribute these materials without our express written permission.

9

15. Disclaimer and Limitation of Liability

Our services are provided on an "as is" and "as available" basis. Musical progression relies heavily on the student's independent practice; therefore, we do not guarantee specific performance results. Melophonics Conservatory will not be liable for any indirect, incidental, special, or consequential damages resulting from the use of our services, nor for any physical injuries sustained on the premises unless caused by our direct negligence.

16. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

17. Changes to these Terms and Conditions

We reserve the right to make changes to these terms and conditions at any time. Your continued use of our services following any changes indicates your acceptance of the new terms.
